Terms of Reference

  1. The CCLS Professional Liability Insurance Committee shall be composed of five members, one of whom shall be the CCLS Executive Director, who shall serve as Secretary to the Committee, and one of whom shall be chosen from the Board of Directors to serve as the Director Liaison. With the exception of the CCLS Executive Director, the members shall be chosen to represent the various regions of the country served by the CCLS professional liability insurance program.

    Committee members shall be appointed by the Board of Directors and may be based on the recommendation of the PLIC.

    Each member, with the exception of the Director Liaison and the CCLS Executive Director, shall serve a four-year term, ending immediately after the spring PLIC meeting, with the possibility of renewal. A schedule of retirement dates for the members of the Committee shall be maintained by the Committee secretary. This schedule may be subject to adjustment from time to time, by the Board of Directors, to maintain a rotation of members and to ensure continuity within the Committee.

  2. All members shall be aware of, and respect, the strictly confidential nature of claims information supplied by the Insurers for the restricted use of the Committee, and shall sign a confidentiality agreement upon assuming membership on the Committee.

  3. An annual honorarium of $6000 is to be provided from the Loss Control Fund; half to be paid to the Chair as an honorarium, and half to fund the position of the Secretary of the Committee.

  4. The CCLS Professional Liability Insurance Committee shall be responsible for the management and direction of the Professional Liability Insurance program in consultation with the Insurers. The Committee shall meet regularly with the insurers, negotiating renewals and changes to the program at their discretion.

  5. The CCLS Professional Liability Insurance Committee shall plan and assist the Insurers in presenting Loss Prevention information to all insureds which may include seminars and/or published information in various formats and may also include general information available to individual CCLS members not insured through the CCLS programme.

  6. The CCLS Professional Liability Insurance Committee shall collect an annual loss control levy from each insured through the auspices of the annual premium, said levies shall be held in trust on behalf of the insureds, and shall be used to fund the loss prevention and committee management expenses and such other activities that further the interests of the insurance program.

  7. The CCLS Professional Liability Insurance Committee shall be accountable for, and have full use and discretion to use all monies collected from member Insureds, as loss control funds. All funds shall however, as long as the Committee is not a legal entity unto its own, be deposited in a special Loss Control account with the CCLS. Authorization for expenditures up to $5,000 shall be at the discretion of the Committee. Expenditures in excess of $5000 require approval in accordance with the authority to commit guidelines All cheques shall be signed by the normal signing authorities for the CCLS.

  8. The CCLS Professional Liability Insurance Committee shall present an annual budget of revenues and expenditures to assist the Secretary-Treasurer in managing the funds.

  9. The CCLS Professional Liability Insurance Committee shall meet as necessary, shall report to the Board of Directors at least annually, and shall meet with the Executive on request.

  10. The CCLS Professional Liability Insurance Committee shall meet with the insurer twice each year to review all claims with indemnity reserves exceeding $20,000. When called upon, the Committee Members may provide advice to the insurer and may make recommendations respecting the selection of professional witnesses.
